General Terms and Conditions for Takeaway and Delivery Orders
1. Ordering Process:
Customers can place orders by phone, online via our website, or in person at the restaurant. Orders must be confirmed by the restaurant before being considered valid.
2. Menu Items:
All menu items are subject to availability. We reserve the right to substitute or change ingredients based on market availability.
Special requests (e.g., dietary restrictions, allergy concerns) must be clearly communicated at the time of ordering.
3. Pricing and Payment:
Prices shown on the menu are subject to change without notice.
All orders must be paid for at the time of ordering. We accept cash, credit/debit cards, and mobile payment options.
Payment delays may result in order cancellation.
4. Takeaway Service:
Customers are responsible for ensuring the accuracy of their order when collecting it at the restaurant. The restaurant is not responsible for errors in the order once it has been picked up.
5. Delivery Service:
Delivery is available within a specific radius around the restaurant, which is communicated on our website.
Delivery fees may apply and will be specified at the time of ordering.
Delivery times are estimated and may vary due to external factors.
6. Customer Responsibility:
Customers must ensure someone is available to receive the delivery at the specified address.
The restaurant is not responsible for missed or unsuccessful delivery attempts due to incorrect address details provided by the customer.
7. Refunds and Cancellations:
Cancellations must be made as soon as possible and may be subject to fees depending on when the cancellation is made.
Refunds only apply to incorrect or missing items, and such claims must be made within 24 hours of the transaction.
8. Health and Safety:
Our restaurant complies with all health and safety regulations.
Please inform our staff of any allergies or intolerances before ordering.
9. Scope:
These general terms and conditions apply to any proposal, offer, and contract made in connection with the products and/or services we offer.
10. Intellectual Property Rights:
Our websites, logos, texts, photos, names, and generally our communications are protected by intellectual property rights belonging either to us, our suppliers, or other rights holders.
It is forbidden to use and/or modify the intellectual property rights described in this article. For example, customers are not authorized to copy or reproduce our drawings, photos, names, texts, logos, color combinations, etc., without our prior express written permission.
11. Privacy and Data Protection:
We are responsible for the processing of your personal data and we process it in accordance with the General Data Protection Regulation.
12. Liability:
We disclaim all liability except in cases of serious or intentional misconduct. We are also not responsible for direct or indirect damages for which we have not expressly provided for our liability in these terms. Our liability will in all cases be limited to the amount of the price set for this order (excluding VAT).
We make every effort to ensure that the website is accessible 24 hours a day, 7 days a week. Given the technical characteristics of the internet and computer tools, and given the need to periodically perform maintenance, updates, or upgrades, we cannot, however, guarantee uninterrupted access and service provision. In the event of a normally acceptable interruption or disruption of access or service provision, we make every effort to resolve this as quickly as possible.
13. Jurisdiction and Applicable Law:
All disputes relating to or arising from our offers and/or contracts are governed by Belgian law. In case of litigation or dispute, only the courts of the district where our registered office is located will have jurisdiction.
14. Modifications to Terms:
The restaurant reserves the right to modify these general terms and conditions at any time. Updates will be communicated on our website.
